1. Who we are

The Magic SPA online shop at magicspa.ro is operated by S.C. Paintpoint S.R.L., registered office: Str. Gheorghe Doja nr. 80, et. 2, Târgu Mureș, județul Mureș, România, Trade Register number J26/1054/2019, tax identification number RO38607949, share capital 100.000 RON. Telephone: +40 33 66 30003. Email: [email protected]. In these terms, “we” and “the seller” mean this company, and Magic SPA is the brand under which the products are sold.

2. What these terms cover

These terms apply to the use of this website and of your customer account. Orders are also governed by the General conditions of sale, which are shown to you before you order; personal data is explained in the Privacy policy and tracking technologies in the Cookie policy.

Browsing the site is not consent to marketing or to optional cookies. Nothing in these terms limits the mandatory rights of consumers.

We may update these terms when the site or the law changes, and we show the date of the new version. An update does not change contracts already concluded: the version that applies to an order is the one published on the day the order was placed.

3. Definitions

Customer: any person who visits the site, opens an account or places an order. Consumer: a customer who buys for purposes outside their trade, business or profession. Business customer: a customer who orders on behalf of a company or other professional. Order: the electronic document by which you tell us that you wish to buy the products in your bag. Contract: the distance contract concluded between you and us, without both parties being physically present.

4. Your account

You can order as a guest or open an account. An account keeps your details, your orders and your subscriptions in one place. Please give accurate information, keep your password to yourself and tell us if you think someone else has used your account. We store passwords only in encrypted (hashed) form and will never ask you for your password by email or telephone. We do not hold you automatically responsible for everything done through your account: a security incident is assessed on its facts and under the law.

Orders may be placed by persons aged 18 or over. You can ask us to close your account at any time. Closing an account does not cancel existing orders, your right of withdrawal or the legal guarantee, and does not delete documents that the law requires us to keep.

5. Fair use

You may browse the products, ask for information and use the functions of the site for lawful purposes. It is not permitted to compromise the security of the site, to access other people’s accounts or data, to send malicious code, to place fraudulent orders or to use the forms for unlawful or abusive messages. The protective measures we take are proportionate and do not prevent you from exercising your rights under orders already placed.

6. Content and intellectual property

The texts, photographs, graphics and the Magic SPA name and logo belong to us or to our licensors and are protected by law. You may view, download and print pages for your personal, non-commercial use, and you may keep the documents of your contract. Any other use that needs the owner’s consent requires our written agreement; the exceptions the law provides, such as quotation, remain available.

Links to external services are marked as such. A link does not mean that we operate that service or that our privacy policy covers it.

7. Product information

We describe our products with care and photograph the real packaging; colours may look slightly different on your screen. This does not allow us to deliver a product other than the one you ordered, and it does not exclude our liability for an inaccurate description. Our products are cosmetic and fragrance products, not medicines: they do not treat or prevent any condition, and general information about bath rituals is not medical advice. Always follow the directions and warnings printed on the label of the product you have in your hands; where the site and the label differ, the label applies.

If a price or a description contains an obvious error, we will contact you before we accept the order, and you may keep or cancel it. We do not replace a product with another one without your agreement.

8. Newsletters and messages

We send newsletters only to people who have asked for them, and every newsletter contains a link to unsubscribe. Messages about an order (confirmation, dispatch, invoice, returns) are part of the contract and are sent regardless of your newsletter choice.

9. Reviews and other content you send us

Reviews must reflect your own experience of the product and must not contain unlawful, offensive or promotional content, personal data of other people or health claims. We may refuse or remove content that breaks these rules. When we publish reviews, we say whether they come from customers who bought the product from us and how we check this. By sending us a review you allow us to publish it on the site free of charge.

10. Availability and liability

We make reasonable efforts to keep the site available and the information accurate, but the site may be temporarily unavailable for maintenance or for technical reasons; you can then reach us by email or telephone, and your rights under existing contracts are not affected. Each party’s liability is determined by law. We do not exclude liability that the law does not allow to be excluded, including for harm to life, health or bodily integrity, for fraud or for the breach of consumers’ mandatory rights.

11. Force majeure

Neither party is liable for failing to perform an obligation because of an event that could not be foreseen or prevented, as defined by Romanian law, for as long as that event lasts. If it lasts longer than 30 days, either party may end the contract without compensation.

12. Applicable law and disputes

These terms are governed by Romanian law. If you are a consumer living in another Member State of the European Union, you also keep the protection of the mandatory rules of the country where you live.

We will always try to settle a complaint amicably: write to [email protected]. Consumers may also turn to the National Authority for Consumer Protection (ANPC), anpc.ro, and may use alternative dispute resolution (SAL), reclamatiisal.anpc.ro. Disputes that are not settled amicably are decided by the competent Romanian courts, without affecting the right of consumers to bring proceedings before the courts of their place of residence.
